Legal Compliance
Next Candle Predictor operates within the framework of Law no. 5549 on Prevention of Laundering Proceeds of Crime and the regulations of MASAK (Financial Crimes Investigation Board) of Türkiye.
1. KYC Requirements
As a "software tool provider" Next Candle Predictor does not directly provide financial services. However, for user safety and legal compliance, the following information is collected during registration:
Basic Level (All Users)
- Email address (verified)
- Username
- Strong password (minimum 8 characters)
Advanced Level (Paid Plans — Active in Phase 2)
- Full name and surname
- National ID or passport number
- Photograph of identity document
- Liveness verification (selfie)
2. AML Procedures
- Transaction Monitoring: User activity on the Platform is monitored for suspicious transaction patterns.
- Suspicious Transaction Reporting (STR): In line with MASAK regulations, transactions deemed suspicious are reported to the relevant authorities.
- Sanctions Screening: User information is screened against international sanctions lists (OFAC, UN, EU).
- Data Retention: Per MASAK regulations, all transaction records and customer information are retained for 10 years.
3. Compliance Officer
A designated compliance officer within our organization is responsible for managing KYC/AML processes, staff training, and regulatory reporting.
4. Geographical Restrictions
- Blocked Countries: United States (blocked at the initial stage due to SEC/CFTC regulatory risks).
- Restricted Regions: Countries and regions on the OFAC sanctions list.
- IP-based geographical controls are applied; additional verification may be requested when VPN usage is detected.
5. Risk Assessment
Users are evaluated based on a risk-based approach:
- Low Risk: Free account, paper trading, verified email.
- Medium Risk: Paid plan, active exchange connection.
- High Risk: High-volume transactions, multiple exchange connections, suspicious activity patterns.
6. Account Suspension / Closure
Your account may be suspended or closed in the following cases:
- Failure to complete KYC verification within the requested period.
- Use of fake or stolen identity information.
- Detection of suspicious transaction patterns.
- Match found on sanctions lists.
- Request from legal authorities.
7. User Rights
- Personal data collected during the KYC process is protected under KVKK.
- You have rights of access, correction, and deletion regarding your data (subject to legal retention obligations).
- You have the right to object to KYC verification results.
